1. Acceptance
By using this website or submitting an estimate request, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the site.
2. What Citrus is (and isn't)
Citrus Painting Co., operated by Modern Ocean ("Citrus," "we"), is a lead-referral service. We connect homeowners and businesses with independent local painting contractors who may contact you to provide a free estimate.
Citrus does not perform painting or any related work, and is not a party to any agreement between you and a contractor. Each contractor is an independent business, solely responsible for its own licensing, insurance, pricing, quotes, contracts, scheduling, workmanship, warranties, and compliance with law. Any contract for painting work is strictly between you and the contractor.
3. Estimates are free and non-binding
Requesting an estimate places you under no obligation. Prices, timelines, and scope quoted by a contractor come from that contractor, not from Citrus, and are subject to the contractor's own terms.
4. No endorsement or warranty regarding contractors
While we aim to work with reputable local painters, Citrus does not guarantee, warrant, or assume responsibility for any contractor's licensing, insurance, availability, conduct, pricing, or the quality, safety, or outcome of any work performed. Your dealings with a contractor — including any decision to hire — are at your own discretion and risk. We encourage you to verify a contractor's license and insurance and to review any written agreement before work begins.
5. Your submissions
You agree to provide accurate information and to submit only your own information. By submitting the form you consent to be contacted as described in our Privacy Policy. Do not submit unlawful, abusive, or misleading content.
6. Acceptable use
You agree not to misuse the site — no attempts to breach security, scrape or overload the service, submit spam or automated entries, or interfere with its operation.
7. Intellectual property
The website design, text, graphics, and logos are owned by us or our licensors and are protected by law. You may not copy, reproduce, or reuse them without permission.
8. Disclaimers
The website and referral service are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, Citrus and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the site or your dealings with any contractor. Nothing in these terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold Citrus and its operator harmless from claims arising out of your misuse of the site or your dealings or agreements with a contractor.
11. User content & takedown
When you submit information or content through this site (for example, details in the estimate form, or a review or photo you choose to send us), you grant Citrus a non-exclusive, royalty-free license to use it to provide and, with your permission, promote the service. You are responsible for what you submit and confirm you have the right to submit it. We are not obligated to monitor content, but we may remove, decline to publish, or take down any content at our discretion — including anything we believe is unlawful, infringing, false, or abusive. Consistent with Section 230 of the Communications Decency Act, we are not responsible for content provided by third parties.
12. Copyright (DMCA)
We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act. See our Copyright/DMCA Policy for how to submit a takedown notice or counter-notice, and for our repeat-infringer policy.
13. Use of AI
We may use artificial-intelligence tools to help build and operate this site and to draft communications; content is reviewed for accuracy, and we do not use AI to generate fake reviews or testimonials. If we ever use an automated system (such as a chatbot or auto-responder) to communicate with you, we will disclose that you are interacting with an automated system rather than a live person.
14. Arbitration & class-action waiver — please read; this affects your legal rights
Most issues can be resolved quickly — please contact us first at [email protected]. If we can't resolve a dispute informally, you and Citrus agree that any dispute arising out of or relating to these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims.
- Class-action waiver: disputes will be arbitrated only on an individual basis; you and Citrus each waive any right to participate in a class, collective, or representative action.
- Carve-out: this section does not apply to any dispute that, under the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, may not be subject to pre-dispute arbitration.
- 30-day opt-out: you may opt out by emailing [email protected] within 30 days of first accepting these terms, stating your name and that you opt out of arbitration. Opting out won't affect any other part of these terms.
- The Federal Arbitration Act governs this section. If the class-action waiver is found unenforceable, this arbitration agreement is void only as to that claim, which then proceeds in court.
15. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Subject to the arbitration section above, any dispute will be handled in the state or federal courts located in Orange County, Florida.
